B2B partnership terms
General terms of collaboration between Ourway Travel S.L. and the travel agencies registered at dmc.ourway.travel.

1. Purpose
These terms govern the collaboration between Ourway Travel S.L. (VAT B22992317, travel agency licence XG-LU-000236, registered office at Rúa do Mercado 17B, 27200 Palas de Rei, Lugo, Spain), hereinafter "Ourway", and the travel agency or tour operator applying for an account at dmc.ourway.travel, hereinafter "the Agency". Ourway acts as an incoming agency (DMC) for the Camino de Santiago and organises the accommodation, luggage transport, transfers and activities that the Agency books for its clients.
2. Registration and approval
Registration is free and does not imply any purchase obligation. Ourway reviews every application (agency licence, tax ID and contact details) and activates access within an indicative period of 24 to 72 working hours. Ourway may reject, suspend or cancel the access of an Agency that cannot prove its status as a travel agency, breaches these terms or misuses the portal.
3. Commercial terms
Ourway works with net rates or with a commission on the retail price, as agreed at approval. The commission percentage applicable to the Agency is shown in its portal profile and is applied automatically to every proposal. Prices include applicable indirect taxes unless otherwise stated. Local tourist taxes, where they exist, are shown separately.
4. Proposals and confirmation
Proposals sent by Ourway through the portal are valid for the limited period stated in the proposal itself. A booking is confirmed upon acceptance of the proposal and payment of the initial amount according to the stated payment policy. Until then, accommodation availability is not guaranteed.
5. Payments
Payments are made by bank transfer or card through Ourway's secure payment gateway, in the currency and within the deadlines stated in each proposal. The Agency is responsible for collecting payment from its end client. Ourway invoices the Agency for the services booked.
6. Changes and cancellations
Each proposal states the applicable cancellation policy, which depends on the conditions of the suppliers included. Changes after confirmation are handled subject to availability and may involve price differences. Cancellations must be notified in writing to [email protected].
7. Liability
Ourway is responsible for the proper performance of the services booked, under Spanish package travel legislation. Ourway holds civil liability insurance (policy 026S00021RCA) and an insolvency guarantee of €600,000. The Agency is responsible for the information it passes on to its clients and for meeting its own legal obligations towards them.
8. Use of the portal and credentials
Access credentials are personal. The Agency is responsible for the use made of them by the members of its team to whom it grants access. The portal may not be used for purposes other than requesting and managing services for the Agency's clients, nor may its content be extracted or reproduced without authorisation.
9. Marketing material and branding
Ourway provides the Agency with texts, photographs and route sheets for commercial use in promoting Ourway services. Any other use requires prior written authorisation. The Agency may sell the services under its own brand (white label) provided that the traveller's final documentation identifies Ourway as the organiser.
10. Data protection
Ourway and the Agency process travellers' personal data in accordance with Regulation (EU) 2016/679 and Spanish law. The Agency warrants that it has the legal basis required to share with Ourway the client data strictly necessary to provide the services. 11. Term and termination
The collaboration is of indefinite duration. Either party may terminate it at any time by written notice, without prejudice to bookings already confirmed, which will be performed as agreed.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute shall be submitted to the courts of Lugo, Spain, unless mandatory applicable law provides otherwise.
